NOTIFICATION

Dated Aizawl, the 14th June, 2018 

Whereas the Hon’ble National Green Tribunal in its judgement dt. 22.12.2016 in the matter of Original Application No.199/2014 – Almitra H. Patel – Vs – Union of India & Ors has directed that there shall be complete prohibition on open burning of wastes on lands including at landfill sites.

And whereas the Hon’ble National Green Tribunal in the said judgement directs that for each such incident of default, violators responsible for such burning shall be liable to pay environmental compensation of Rs. 5000/- (Rupees five thousand) only in case of simple burning and Rs. 25,000/-(Rupees twenty five thousand) only in case of bulk wastes burning and that any States, local authorities, concessionaries, facility operators, any stakeholders, generator of wastes and any person who isolates or fails to comply with Solid Waste Management Rules 2016 and the directions contained in the said judgement shall be liable for penal action in  accordance with section 15 of the Environment (Protection) Act, 1986.

Now, therefore, in compliance with the direction of the Hon’ble National Green Tribunal, the Governor of Mizoram is pleased to order complete prohibition on open burning of wastes on lands including at landfill sites in the State of Mizoram. For each such incident or default, violators responsible for such burning shall be liable to pay environmental compensation of Rs. 5000/- (Rupees five thousand) only in case of simple burning and Rs. 25,000/- (Rupees twenty five thousand) only in case of bulk waste burning.

The Governor of Mizoram is further pleased to order that environmental compensation resulting from burning of wastes shall be collected as arrears of land revenue by Mizoram Pollution Control Board in the State Capital and by Deputy Commissioners in their respective jurisdiction.

This order for prohibition of open burning of wastes within the State of Mizoram shall be effective from 01.12.2018.
